PROPERTY OWNER’S

 

CONSENT AND RELEASE

 

 

 

This consent and release is executed this _______________ day of __________________(month),    20 ________, by _____________________ hereinafter "Property Owner" in favor of the State of New Jersey through the Brownfields Redevelopment Task Force, hereinafter "Task Force".

 

WHEREAS, the Brownfields Redevelopment Task Force has been vested with the statutory responsibility of preparing a Brownfields inventory pursuant to N.J.S.A. 58:10B-23 for certain purposes including facilitating the sale, development and/or redevelopment of properties in the State of New Jersey which constitute Brownfields under that statute; and

 

WHEREAS, the Property Owner is the sole owner of and holds legal title to a

particular property located at

which may constitute a Brownfields, if the State approves it as such, within the meaning of that term as utilized in the statute; and

 

WHEREAS, the Property Owner recognizes and acknowledges that there may be benefits of having the property, to which this consent and release pertains, included in the Brownfields inventory which has been made available to the public by the Task Force; and

 

WHEREAS, the Property Owner hereby grants express authorization to the Task Force to include the property in its Brownfields inventory and therefore releases any claims by the Property Owner against the State of New Jersey with regard to the inclusion of the property in the Brownfields inventory and any related activities undertaken by the Task Force with respect thereto;

 

NOW THEREFORE, in consideration of any benefits received by the Property Owner in having the property to which this consent and release pertains included in the Brownfields inventory, the Property Owner hereby consents to inclusion of the property in the Brownfields inventory, if the Task Force desires to include it, and to the Task Force taking such actions as it deems to be reasonably necessary to market the property, where appropriate, consistent with statutory mandates. The property owner hereby releases the State of New Jersey from any claims which the Property Owner may, have relating to the inclusion of the property in the Brownfields inventory.

This authorization to publish property as a brownfields, should the State decide to do so, in no fashion imposes or results in the imposition of any liability for the Property Owner(s) in addition to any liability that may already exist by operation of existing laws. By extending this authorization to the Brownfields Redevelopment Task Force, the Property Owner(s) executing the Consent form makes no admission of any liability or fault, nor does Property Owner(s) make any admission as to the condition of the subject property. By Owner(s) executing this Consent form, and by the Task Force accepting it, it is agreed that neither the Task Force nor Property Owner(s) will institute claims against each other solely due to this authorization for publication of the property on SiteMart."
